Sri Lanka: Court suspends refugee deportations


All the family members of the petitioner are asylum seekers and their applications are pending while the petitioners family members have been arrested, the counsel stated.

President of the Court of Appeal, Justice A.W.A. Saleem, yesterday issued an interim order suspending the decision of the Minister of Defence to deport asylum seekers and refugees, who are registered with the United Nations Human Rights Commission for Refugees in Sri Lanka.

The Court issued this order after considering a petition filed by Mrs. Aneela Imran of 191/1 Dehimalwatta Road, Negombo.

Court also issued notice, returnable on 29 August, on the respondents cited in the petition.

W.A. Chulananda Perera Controller Immigration and Emigration Department, Minister of External Affairs, Secretary to the Ministry of External Affairs, Secretary Human Rights Commission, Ministry of Defence, Secretary to the Ministry of Defence, N.K. Illangakoon, Inspector General of Police and the Attorney General have been cited as respondents in this petition.

Counsel for the petitioner Lakshan Dias submitted to Court that he is 38 years old, married to Imran Younis and the mother of three children and her father Gulzar Javed and her brother Robin Jahangier were arrested by Sri Lanka Immigration with the support of the police on 12 June 2014.

All the family members of the petitioner are asylum seekers and their applications are pending while the petitioners family members have been arrested, the counsel stated.

He contended that among the family members of the petitioner one was a minor and it was a violation of the Child Rights convention.

Most of the persons arrested are Pakistani Nationals, who are either Christians or Shia Muslims and Ahamadi Muslims of Islam sects and according to them they are being persecuted in Pakistan due to their religious belief counsel, submitted to Court.

The Petition requested Court to issue interim relief directing the respondents to stop deportation of any asylum seeker.

Attorney-at-Law Lakshan Dias appeared for petitioner instructed by Thushara N. Daskon.
