Court has tread a careful path; while in upholding the capital punishment it has been sensitive to the liberal sections, intelligentsia and international concerns, in striking down section: 7 of Anti-Terror Act (ATA) it has made it difficult for Mumtaz Qadri to be executed or demands arising for such executions in the current public mood and commitment to executions which is mainly focused on terrorism related charges.

This has been a smart move. Court has satisfied both sides. Islamists will be relieved for no immediate case or demand for execution will arise and liberals and international community (who are a different category of hypocrites; insisting on death to Islamists but taking position against death penalty in general) will have no more cause for protests and agitation.

While Mumtaz Qadri and his peculiar case represented a special challenge for Pakistani state and society, in general the restricting of executions only to those convicted under terrorism is a pathetic compromise which poorly managed Pakistani state has done and is against the letter and spirit of Pakistani constitution. All or most convicted for Capital punishments, and whose appeals have been turned down must be executed - unless we can create the new punishment of "Life Without Parole (LWOP)" like the American Criminal System, in which those convicted for life never see the outside of a prison.
